COMPARATIVE ANALYSIS OF CRIMES COMMITTED IN THE TWENTIETH CENTURY AND IN OUR TIME IN EXCESS OF THE REQUIRED LEVEL OF SELF-DEFENSE

Abstract

The Criminal Code of the Republic of Azerbaijan, adopted in the 1960 s and entered into force on March 1, 1961, is based on the principles of a socialist society and is closely related to the system of totalitariannism and administrative government. Since the outdated non-democratic legislation with its principles and requirements could not effecttively regulate the social changes taking place in the Republic of Azerbaijan, it did not fit the concept of a democratic state with the rule of law. From this point of view, the necessary requirements arose to remove the "criminal law" from a defensive position, to implement reforms based on the protection of new social values. The new "Criminal Code" of the Republic of Azerbaijan, which came into force on 01.09.2000, became an expression of this need. The new Criminal Code has strengthened the protection of life, health, human rights and freedoms, and has democratized criminal law in general.
